9.1 We may amend these Terms at any time. Continued use constitutes acceptance.
General Provisions & Scope
1.1 These Terms constitute the complete agreement between you and Zilmac ('we', 'Platform') regarding use of cloud Mac compute resources and related technical services. Plan descriptions, pricing rules, announcements, and order details confirmed by you published on the website are all supplementary parts of these Terms.
10.1 These Terms are governed by the laws of Zilmac's registration jurisdiction.
10.2 Disputes shall first be resolved by negotiation; if unsuccessful, submitted to the court at the place of registration.
1.4 The Privacy Policy and these Terms together form the complete agreement. Personal data processing is governed by the Privacy Policy; fees, service availability, liability caps, and dispute resolution are governed by these Terms. Please read both.Privacy Policy。
Service Description & Orders
2.1 This service is provided 'as-is' and 'as available'. Specifications, illustrations, and performance descriptions on pages are for selection reference only and do not constitute a guarantee of experience, throughput, or uninterrupted operation for specific business scenarios, unless we separately provide a written SLA for that order.
2.2 Your order submitted on the Pricing page constitutes an offer; we accept upon confirming receipt of payment or sending an order success notification. For obvious pricing errors, insufficient inventory, or compliance reasons, we may decline or partially fulfill orders; payments received will be handled via the original channel or per announced procedures.
2.3 Where 'order without login' is supported, you must complete account binding and identity verification (if applicable) within the specified period; otherwise we may decline to activate or may terminate resources, with fees handled per §8 and announced rules.
2.4 After successful payment, resource activation depends on inventory, region, risk review, upstream supply, and your cooperation in providing information and tickets. Absent written commitments, we make no definitive guarantee on activation timing; delays caused by your late cooperation are your responsibility.
Payment, Login & Compliant Use
This part sets out billing cycles and renewals, account security obligations, and responsibility allocation for data and network use.
Pricing, Payment & Billing Cycles
3.1 Prices are as shown on the page at the time you place and complete payment. We may adjust published prices based on costs, exchange rates, taxes, or commercial strategy; adjustments are not retroactive to active unexpired orders, unless required by law or separately notified. Currency, payment fees, and taxes are borne by you and the payment institution per local rules.
3.2 Daily billing is generally a one-time prepayment with no auto-renewal upon expiry. Weekly/monthly/quarterly periodic billing will auto-deduct the next cycle's fee per published rules before the current cycle ends, unless you explicitly disable auto-renewal in the subscription page or account settings. You must maintain a valid payment method; non-payment constitutes a material breach, and we may immediately suspend or reclaim resources without refunding fees for the consumed period (except as required by law).
3.3 You must pay through the payment channels designated by the Platform. For chargebacks, abuse of chargeback mechanisms, or exploiting payment loopholes, we may permanently decline transactions, pursue debts, and seek compensation for reasonable costs.
Account & Security
4.1 Your account and all access credentials (including passwords, tokens, API keys) are for your exclusive use at your own risk. We are not liable for losses arising from disclosure, credential sharing, or failure to exercise reasonable care.
4.2 For contract performance, security audits, and technical support, we may take reasonably necessary monitoring and access control measures at the external host layer, console, and metadata layer, with or without prior notice as required by law; you may not obstruct freezes or audit trails required for law enforcement cooperation or rights claims.
4.3 When we have reasonable grounds to suspect unauthorized access, fraud, money laundering, prohibited content, or attack behavior, we have the right to take measures without prior notice – including restricting logins, rate limiting, freezing orders, suspending instances, or deleting non-compliant snapshots – until the risk is resolved or you complete supplementary verification. Business interruptions or data unavailability resulting from such measures do not constitute a breach by us, except as required by law.
4.4 Password reset procedures are subject to real-time in-platform prompts; we may upgrade verification methods (e.g., manual review) to protect account security.
Acceptable Use & Prohibited Conduct
5.1 You warrant that your use of this service complies with all applicable laws and regulations, and that you will not use resources for any illegal or infringing purpose. Prohibited conduct includes but is not limited to:
- Conduct that is illegal in any relevant jurisdiction or that could expose the Platform to administrative/criminal liability;
- Infringing others' intellectual property, privacy, reputation, trade secrets, or disseminating illegal information;
- Unauthorized intrusion, scanning, mining, spam, network abuse, and attacks on third parties;
- Abusing promotions or payment systems through false identities, cash-outs, money laundering, or price manipulation.
5.2 Upon finding or reasonably suspecting a violation, we may unilaterally decide to: warn, rate-limit, remove content, shut down, terminate service, permanently ban, report to authorities, cooperate with investigations, and, to the extent permitted by law, confiscate or offset prepaid fees equivalent to the breach as a reasonable estimate of liquidated damages/compensation. We are not obligated to argue each point with you before taking such measures, but may provide post-hoc explanations consistent with investigation obligations.
Data, Network & IP
6.1 The legality, licensing, and backup of data and applications in your instance are solely your responsibility. Except for circumstances directly and foreseeably caused by our intentional conduct or gross negligence, we are not liable for any data loss, corruption, or business interruption; you agree to establish offline or cross-region backups for critical business scenarios.
6.2 Public network quality, upstream ISP routing, and third-party services are beyond our control; absent a written SLA, we do not guarantee sustained latency, bandwidth utilization, or availability of specific applications.
6.3 IP, bandwidth, and 'dedicated' representations are subject to the product page and order. If your illegal or abusive conduct causes IP reputation damage, blocking, or upstream reclamation, you bear the consequences and must replace resources at cost (if applicable); we have no obligation to compensate you or third parties for indirect losses.
Termination, Liability & Governing Law
This part covers service changes and termination, refunds and compensation caps, amendment procedures, and dispute resolution and official contact channels.
Service Changes, Interruptions & Termination
7.1 For technical upgrades, capacity scheduling, compliance, supply chain changes, or commercial strategy, we may change, replace, or discontinue certain features or regional supply, with reasonable advance notice via website, console, or email. If a change causes material harm that cannot be mitigated by reasonable alternatives, you may apply for a prorated refund for the unfulfilled portion (subject to our review; promotional items, credits, and customized orders excluded).
7.2 You may voluntarily unsubscribe per the rules; activated and consumed periods, liquidated damages, and orders terminated early for your reasons are generally non-refundable unless required by law or committed in writing by us.
7.3 If we terminate service due to your non-payment or breach, we may dispose of resources and billing accounts (including deleting instances and data) and pursue you for arrears and reasonable enforcement costs (including attorney fees and preservation fees, where claimable).
Refunds, Disclaimers & Liability Limits
8.1 Refunds are subject to our published rules, special order terms, and written replies from tickets/customer service. For customized, promotional, marked non-refundable, already activated and consumed, or suspected abuse/fraud orders, we may deny refunds in whole or in part.
8.2 To the maximum extent permitted by law, regardless of the basis (contract, tort, or otherwise), our total aggregate liability to you for this service is capped at the net amount actually paid by you to us in the twelve (12) months preceding the dispute for the disputed resources (excluding third-party collections and taxes). We are not liable for lost profits, lost goodwill, data loss, indirect, or punitive damages, except for death or personal injury caused by our intentional misconduct or gross negligence, or where mandatory law prohibits exclusion.
8.3 We are not liable, to the extent permitted by applicable law, for performance failures caused by force majeure, your or third parties' conduct, government action, upstream power/network outages, audits, or judicial measures.
Amendment & Notices
9.1 We may amend these Terms at any time; amendments take effect upon publication on the website, or on a future date stated in the announcement. Where amendments materially increase your cost burden or significantly limit your rights, we will endeavor to give reasonable advance notice; if you disagree, you should stop using the service and settle fees before the effective date, otherwise you are deemed to unconditionally accept.
9.2 You acknowledge that continued use of the service or renewal payment constitutes irrevocable acceptance of the amended Terms.
Governing Law & Dispute Resolution
10.1 These Terms shall be governed by the laws of the jurisdiction in which Zilmac's operating entity is incorporated. If you are a consumer and the mandatory laws of your habitual residence are more favorable to you, those non-waivable mandatory provisions may apply with respect to those rights, but shall not automatically invalidate the remainder of these Terms.
10.2 Disputes should first be resolved through negotiation; if unresolved, they shall be submitted to a court with jurisdiction in the place of incorporation of the operating entity. To the extent permitted by law, you agree not to initiate representative or class proceedings relating to the same dispute that are not directly relevant to your individual interests; except where mandatory procedural law provides otherwise.

Notices, bills, and dispute correspondence related to these Terms may be delivered to your registered email, console messages, or SMS; delivery is deemed complete upon sending, unless you can prove the system was persistently unavailable.
